This 2026 Exhibit Booth Contract (Contract) is entered by and between the (Contract Holder) and The Great Western Show (TGWS).

The parties agree:

1. Subject to the terms of this Contract, the Contract Holder is entitled to occupy a exhibit booth(s) as defined solely by TGWS from March 19th through March 22nd, 2026 during The Great Western Show in the Pacific Steel & Recycling Arena located in the Montana ExpoPark - 300 3rd St. NW, Great Falls, Montana, 59404

a.) Move in date is Wednesday, March 18th, 2026 from 8:00 a.m. to 8:00 p.m.
b.) Move out date is Sunday, March 22nd, 2026, Starting at 2:00 p.m.
c.) Hours of the show: Thursday through Saturday, March 19th -21st, 2026 10:00 a.m. to 8:00 p.m. Sunday, March 22nd, 10:00 a.m. to 2:00 p.m. .

2. The Contract Holder agrees to pay the assigned rental fee for their exhibit booth(s) by check or credit card directly to Stoneworks Communications, DBA The Great Western Show by March 1, 2026. This fee is non-refundable.

3. If these fees are not received by the aforementioned deadline, the exhibit booth(s) shall be released, and the Contract Holder shall have no right of occupancy or use.

4. The Contract Holder shall not re-assign this agreement or sublet, share, transfer, or otherwise permit the use of the contracted exhibit booth to any other party without the express written consent of TGWS.

5.The Contract Holder acknowledges and agrees that TGWS, in its sole discretion, selects and determines the exhibitors from year to year. It is also understood that nothing in this contract implies a continuing or renewable agreement, but rather the contract is negotiated on a year-by-year basis.

6. The Contract Holder acknowledges and agrees to be bound by the Exhibit Booth Policies and the Exhibit Booth Information Sheet (collectively, the Policies). Henceforth, the Contract Holder is solely responsible for the condition of the Exhibit Booth being rented.

7. Contract Holder and its assignees may not use an exhibit booth for any purpose other than as allowed for and approved by TGWS.

8. TGWS, including its officers, directors, employees, agents, contractors, representatives, insurers and volunteers will not accept any responsibility for the care, security, safety or wellbeing of any art, consigned merchandise, displays, goods, materials, or personal property owned or in the possession of any Contract Holder before, during, or after this event.

9. TGWS shall not be responsible for loss, theft or damage to art, consigned merchandise, displays, goods, materials, or personal property belonging to Contract Holder or otherwise brought to The Great Western Show by or on behalf of Contract Holder before, during, or after the Great Western Show.

10. TGWS provides no indemnity for loss whether resulting from weather, fire, water, structural/mechanical venue failures, theft, pilferage, acts of terrorism, unexplained disappearance of items, bomb threats, acts of God or any other cause whatsoever. All art, consigned merchandise, displays, goods, materials, or personal property owned or in the possession of any Contract Holder are brought to The Great Western Show and displayed at Contract Holder’s own risk and should be safeguarded at all times.

11. The Contract Holder has been advised to take all necessary steps and precautions to protect all property from such loss, theft or damage, including purchasing “all risks” insurance for any property in the Contract Holder’s possession.

12. Contract Holder further agrees that TGWS is not liable for any injury, loss or damage that may occur to Contract Holder, or to Contract Holder’s employees, agents, guests or property before, during or after The Great Western Show, including but not limited to Contract Holder’s participation in The Great Western Show, the booth bidding and assignment process, and any other direct or indirect cause whatsoever. Contract Holder agrees that it maintains adequate insurance to fully protect Contract Holder and TGWS from any and all claims arising from Contract Holder’s participation in The Great Western Show.

13. Contract Holder assumes responsibility and agrees to indemnify, defend and hold TGWS harmless from and against any claims or expenses (including attorney’s fees) arising out of the (a) the execution of the Contract and the booth assignment process, (b) participation in The Great Western Show, (c) sale of any art or other goods, (d) the use of The Great Western Show facility, (e) authenticity, legal ownership, or claimed infringement of any displayed or sold art works and/or (e) the acts, omissions or negligence of Contract Holder, its employees, volunteers, agents or contractors, by reason of personal injuries, death or property damage or any other cause of action sustained by any persons or others. Contract Holder assumes all responsibility and liability for losses, damages and claims arising out of injury or damage to,or caused by Contract Holder’s displays, equipment, employees or representatives. In no event shall TGWS be liable for any special incidental, indirect, punitive or consequential damages arising out of or in connection with this agreement. The liability of TGWS and Contract Holder’s sole remedy for any claim of loss or damage arising from or related to the Contract, regardless of the form of action, shall be limited to one-half of the fees paid to TGWS under the Contract.

14. TGWS’s aggregate liability, if any, under this Contract or Contract Holder’s participation in The Great Western Show, shall be limited to the room and entry fee paid by Contract Holder to TGWS. Notwithstanding the foregoing, in no event shall TGWS be liable for any special, indirect, incidental, consequential, exemplary, or punitive damages, loss of profits or revenue, or loss of use even if informed of the possibility of such damages. To the extent permitted by applicable law, these exclusions and limitations will apply regardless of whether liability arises from breach of contract, warranty, tort (including but not limited to negligence), by operation of law or otherwise.

15. Contract Holder agrees that TGWS may photograph, publish, and promote Contract Holder’s works of art and the name and likeness of Contract Holder in catalogs, websites, brochures and other publicity materials. All such promotion and publicity of Contract Holder and any works of art shall be at the sole discretion of TGWS.

16. This Contract and its Policies and any addenda attached hereto and agreed to by the parties in writing, constitute the entire agreement between the parties, and supersede any and all prior agreements and arrangements concerning the subject matter hereof, whether oral or written, between the parties.

17. No modification of this Contract shall be binding unless in writing, attached hereto, and signed by both parties.

This agreement shall be construed in accordance with the laws of the State of Montana, excluding its choice of law provisions, and the parties’ consent to the exclusive jurisdiction of courts in Montana to resolve any disputes hereunder. The failure of either party to insist upon the performance of any provision of this Contract, or to exercise any right or privilege granted to that party under this Contract, will not be construed as waiving that provision or any other provision, and the provision will continue in full force and effect. If any provision is found to be illegal, invalid, or otherwise unenforceable by any judicial or administrative body, the other provisions will not be affected and will remain in full force and effect. Provisions herein which by their very nature are intended to survive termination or cancellation of this Contract will survive such termination or cancellation.

This Contract may be executed in counterparts and shall be binding upon and inure to the benefit of the party’s successors, heirs and permitted assigns.
